Membership Terms and Conditions

Welcome to Birdies & Lattes! These Membership Terms and Policies (“Terms”) govern the use of our memberships and related benefits. By purchasing or using a membership, you agree to the following terms:
1. Membership Tiers and Benefits
Birdies & Lattes offers multiple membership tiers, each with unique pricing, benefits, and privileges. Details about specific membership tiers, including pricing, benefits, and booking policies, are outlined at the time of purchase and may be subject to change.
Memberships provide access to designated benefits only and are non-transferable unless explicitly stated.
2. Free Bay Hours Rental Terms
Members receive bay rentals charged by the bay, not per person.
Free bay rental hours included in memberships:
Apply to weekdays only
Allow a maximum of 4 guests per bay in addition to the member.
Free Weekday Bay Hours do not apply to any major federal holiday.
Free bay rental hours max usage in one day is 2, subject to availability.
Free bay hours must be used within the member’s anniversary period and do not roll over.
3. Membership Usage
Reservations for bay rentals can be made via our online platform, or in person, as long as credit card information is on the account for the cancellation policy application.
Unused membership benefits, including free rental hours, are non-refundable.
Loyalty points, gifts, promotional items, and discounts, cannot be redeemed or exchanged for monetary credit or cash or any other item or service. These items are provided solely for the benefit and enjoyment of the member and are not transferable and may not be sold. The member agrees to comply with all terms and conditions related to the use of these items, including any expiration dates or other restrictions. Birdies & Lattes reserves the right to modify or discontinue these items at any time without prior notice.
4. Bay Reservations
Members are encouraged to book in advance to secure preferred times.
Members will have more advanced booking access than non-members.
Reservations must be canceled or rescheduled at least 12 hours in advance to avoid penalties.
Failure to cancel or reschedule within this timeframe may result in a charge equivalent to the reserved bay rental hours.
5. Membership Fees and Renewal
Membership fees are billed monthly on your anniversary sign up date.
Memberships automatically renew unless canceled before the renewal date.
Cancellation requests must be submitted at least 15 days before the next billing cycle.
6. Membership Cancellation & Freezes
You may cancel your membership at any time by notifying us at least fifteen (15) days before your next billing cycle.
Cancellation requests can be made in person at Birdies and Lattes or via email to hello@birdieslattes.com
Failure to provide timely notice may result in one final charge before cancellation takes effect. Members retain their benefits until the end of their last paid membership period.
Members may freeze their membership for up to three (3) months within a calendar year. A freeze is only allowed with a reactivation date. During the freeze period, all member benefits will be temporarily suspended and autopay and benefits will resume at the reactivation date.It is the member’s responsibility to give Birdies and Lattes when their reactivation date will be. If a member needs to extend their freeze period, they must communicate with Birdies and Lattes when the updated reactivation date is. If a member needs to freeze their membership for more than three months, the member must communicate their reason to Birdies and Lattes. Birdies and Lattes will approve or deny the request on a case by case basis.
If a payment fails to process at the start of the reactivation date, Birdies and Lattes reserves the right to suspend the membership benefits until payment is received. While in suspension, the member will continue to incur membership charges and will remain responsible for the full outstanding balance. Membership suspensions do not pause billing obligations unless explicitly stated in writing by Birdies & Lattes.
7. Termination of Membership
Birdies and Lattes reserves the right to terminate memberships for misuse, non-compliance with rules and policies, or fraudulent activity.
In the event of termination, prorated refunds for unused time or benefits will not be provided.
By signing up for a membership, the member acknowledges and waives the right to any prorated refund upon termination of membership.
8. Pricing and Adjustments
Bay rental pricing is subject to periodic review. Details about current pricing and membership benefits are available at the time of purchase.
Birdies & Lattes reserves the right to modify membership benefits, pricing, and terms at its discretion, with prior notification to Members.
9. Liability and Waivers
Members and their guests agree to our liability policy.
Birdies & Lattes is not liable for personal injury, loss, or damage to personal property while on the premises.
Members and guests assume all risks associated with participation
Members and guests are liable for injuries resulting from accidents, improper use of equipment, or other inherent risks
Members and guests are responsible for equipment damages resulting from misuse
10. Miscellaneous
Memberships are governed by the laws of the state in which Birdies & Lattes operates.
Any disputes, claims, or controversies arising out of or relating to these Terms, including the breach, termination, enforcement, or interpretation thereof, shall first be attempted to be resolved through good faith mediation. If mediation is unsuccessful, Birdies & Lattes reserves the right to resolve disputes through either binding arbitration or litigation in a court of competent jurisdiction. The venue for any litigation shall be in Edison, N.J. The parties waive any right to a jury trial. Members also waive the right to participate in any class action or collective lawsuit against Birdies & Lattes.
Birdies and Lattes Membership Auto Pay Policy
1. Authorization for Recurring Payments
By enrolling in a membership at Birdies and Lattes, you authorize Birdies and Lattes to automatically charge your designated payment method on a recurring basis for your membership dues. Charges will be made on the same date each billing cycle, as specified in your membership agreement.This process is done automatically through the POS system used by Birdies and Lattes.
2. Payment Methods
Accepted payment methods for auto pay include credit cards and debit cards. It is your responsibility to ensure that your payment method is valid and has sufficient funds at the time of the scheduled charge.
3. Failed Payments and Declined Transactions
If payment is not successfully processed within seven (7) days of the due date, your membership may be suspended or canceled at the discretion of Birdies and Lattes.
4. Membership Autopay Cancellation
You may cancel your auto pay membership at any time by notifying us at least fifteen (15) days before your next billing cycle. Cancellation requests can be made in person at Birdies and Lattes, via email to hello@birdieslattes.com, or by phone. Failure to provide timely notice may result in one final charge before cancellation takes effect.
5. Refund Policy
Membership dues paid via auto pay are non-refundable. If you cancel after a payment has been processed, you will continue to have access to your membership benefits until one day before the next billing cycle.
6. Updating Payment Information
You are responsible for updating your payment information if your card expires or if you wish to use a different payment method. Updates can be made on the membership portal.
7. Changes to Auto Pay Policy
Birdies and Lattes reserves the right to modify this auto pay policy at any time without prior notice. Members will be notified of significant changes as deemed necessary by Birdies and Lattes.
By enrolling in auto pay, you agree to the terms outlined in this policy.
Membership FAQs
1a. Can I freeze my membership?
Members may freeze their membership for up to three (3) months within a calendar year. It is the member’s responsibility to notify a manager when they wish to reactivate their membership. During the freeze period, all member benefits will be temporarily suspended.
At the conclusion of the freeze period, the member’s account will automatically be charged on the agreed-upon date. If a payment fails to process, Birdies and Lattes reserves the right to suspend the membership until payment is received. While in suspension, the member will continue to incur membership charges and will remain responsible for the full outstanding balance. Membership suspensions do not pause billing obligations unless explicitly stated in writing by Birdies & Lattes.
To cancel a membership, members must notify a manager. However, any outstanding balance on the account remains the member’s responsibility.
1b. Freezing vs Cancelling Membership (Founder’s Club Only)
Founder’s Club Members may freeze or cancel their membership in accordance with the Freeze/Cancellation Policy. However, as Founder’s Club Members that receive exclusive perks, a full cancellation will result in the loss of these benefits.
To retain their perks, we recommend that Founder’s Club Members utilize the allotted freeze period (up to three months) instead of canceling their membership.
If a member needs to extend their freeze beyond three months, they must notify Birdies and Lattes in advance. Extension requests will be reviewed on a case-by-case basis and are subject to approval. Failure to provide notice will result in the automatic enforcement of the Membership Cancellation and Freeze Policy.
If a Founder’s Club Member chooses to cancel, they will forfeit all associated perks. Should they wish to rejoin after cancellation, they will be enrolled as a standard member with the perks available at that time.
2. How do I cancel my membership?
Members may cancel their membership by submitting a cancellation request at least 15 days prior to the next billing cycle. Cancellation requests can be made in person at Birdies and Lattes, via email to hello@birdieslattes.com, or by phone. Cancellations will not result in a prorated refund; instead, the membership will remain active until the day before the next billing cycle to prevent further charges to the card on file. Upon termination, all membership benefits will be forfeited.
3. Can I upgrade or downgrade my membership?
Yes, members can upgrade or downgrade their membership tier at any time. Changes will take effect at the start of the next billing cycle. Please contact us for assistance with upgrading or downgrading.
4. What happens to unused free bay rental hours?
Unused free bay rental hours do not roll over to the next month and are forfeited if not used within the current billing cycle.
5. Can I transfer my membership to someone else?
Memberships are non-transferable. However, you can share your bay rental hours with guests within the guest policies outlined in the membership terms.
6. What if I bring more than the maximum number of guests?
The number of guests allowed per bay is limited to 4 in addition to the member. Additional guests may require renting an additional bay, subject to availability and standard rental rates.
7. Are memberships only valid for weekdays?
Memberships include free bay rental hours that are restricted to weekdays. Any major federal holiday that falls on a weekday is excluded. Additional benefits, such as discounts and loyalty points, can be used any day of the week.
8. Can I book multiple bays with my membership?
Free bay rental hours apply to a single bay per booking. If you need multiple bays, additional bays can be booked at the standard rental rates. Bay rental discount does not apply to multiple bays. Bay rental discounts only apply to the bay the member is on.
9. What is the booking window for members?
Members can book bays up to 21 days in advance. Early booking is encouraged to secure preferred times.
10. Can I suspend my membership if I have unused benefits?
Membership suspensions are separate from the use of benefits. Free bay rental hours and other benefits cannot be paused or carried forward during a freeze.
11. How do I check my remaining free bay rental hours or discounts?
Members can view their remaining punchcards (free bay hours) and loyalty points by logging into their membership account online or via app. Discounts are automatically applied in-store as long as you are a member and your profile is attached to your tab/order.
12. What happens if I arrive late for my booking?
Late arrivals will still count as part of the booked bay rental time. Extensions are subject to availability and standard rental rates.
